AMENDING APPELLATE RULE 502(c), 1639 (Alaska 10-15-2007)

Amending Appellate Rule 502(c), Civil Rule 6(c), and Criminal Rule 40(d)concerning additional time after mailing of documents by the court, andcomputation of time.

IT IS ORDERED:

1. Appellate Rule 502(c) is amended to read as follows:

Appellate Rule 502. Time — Computation and Extension.

(c) Additional Time After Service or Distribution by Mail. Whenever a party has the right or is required to do some act or take some proceedings within a prescribed number of days period after the service or distribution of a document, of a notice or other paper upon the party and the document notice or paper is served or distributed upon the party by mail, three calendar days shall be added to the prescribed period. This paragraph does not extend any time period calculated from a date under Civil Rule 58.1 or Criminal Rule 32.3. However, no additional time shall be added if a court order specifies a particular calendar date by which an act must occur.

2. Civil Rule 6(c) is amended to read as follows:

Civil Rule 6. Time.

(c) Additional Time After Service or Distribution by Mail. Whenever a party has the right or is required to do some act or take some proceedings within a prescribed period after the service or distribution of a document, of a notice or other paper, other than documents served under Civil Rule 4(h), upon the party and the document notice or other paper is served or distributed upon the party by mail, three calendar days shall be added to the prescribed period. This paragraph does not extend any time period calculated from a date under Civil Rule 58.1. However, no additional time shall be added if a court order specifies a particular calendar date by which an act must occur.

3. Criminal Rule 40(d) is amended to read as follows:

Criminal Rule 40. Time.

Whenever a party has the right or is required to do an act within a prescribed period after the service or distribution of a document, of a notice or other paper upon the party and the document notice or other paper is served or distributed upon the party by mail, three 3 calendar days shall be added to the prescribed period. This paragraph does not extend any time period calculated from a date under Criminal Rule 32.3.
